Terms & Conditions

This agreement governs your use of LK Sport site and services, including all orders made or processed for products or services in connection with the site and services, and the user Forums which LK Sport makes available. You and LK Sport (M) Sdn. Bhd., a Delaware corporation providing custom, on-demand merchandise printing, sales, and other related services (“LK Sport”), are the parties to this agreement. If you choose to use other features of the site and services, other terms may apply in addition to those. No exceptions to these terms are effective unless LK Sport has agreed to them in writing.

LK Sport may change these terms from time to time. If LK Sport makes changes to these terms, you will be asked to accept the new terms as a condition of continuing to use LK Sport site and services. If you disagree with any amendments, you must stop using LK Sport site and services.

Use of the Site and Service Generally

LK Sport owns all intellectual property and other rights, title and interest in and to its site and services (except for user-provided content). Your use of the site and services does not grant you any right, title or interest to these properties, except as follows. LK Sport grants you a limited, revocable license to access and use the site and services for its intended purpose: the provision of an online, on-demand, customizable merchandising solution. You may only use the site and services according to LK Sport terms, rules, and guidelines found on its site, and LK Sport may revoke this license and limit your access to the site and services according to Section 15 (Termination of Access).

You may not:

interfere with the site and services by using viruses or any other programs or technology designed to disrupt or damage any software or hardware;
modify, copy, create derivative works from, reverse engineer, decompile or disassemble any technology used to provide the site and services;
use a robot or other automated means to monitor the activity on or copy information or pages from the site and services, except search engines, traffic counters, or similar basic performance monitoring technology;
impersonate another person or entity;
use any meta tags, search terms, keywords, or similar tags that contain LK Sport name or trademarks;
engage in any activity that interferes with another user’s ability to use or enjoy the site and services, including activity that places a disproportionate burden on the site and services compared to ordinary use from a single, ordinary user;
assist or encourage any third party in engaging in any activity prohibited by this agreement; or
use the site and services to promote hate speech, obscenity, or any content that violates LK Sport Ethical Guidelines, which LK Sport may change from time to time in LK Sport sole discretion.

Any attempts of frauds will be reported to the police. LK Sport reserves the right to cancel, hold on to, or further investigate an order at suspicion, even if delivery time is affected. LK Sport holds the right to have minor deviations related how material, color, weight, measurements, or manufacturing, appear on our online shop. This also includes type faults, price and stock changes.

Delivery & Shipment

LK Sport warrants that it will ship orders within three weeks after orders are placed. Normally, goods are shipped within a few days and typical delivery times are 2-4 days, but in certain circumstances shipment and delivery can take up to three weeks. Customers and LK Sport may separately agree to more specific delivery times and terms in a separate writing or agreement (such as a request for express shipping).

International taxes and duties

Your order may be subject to import duties and taxes, which are levied once a shipment reaches your country. We cannot control and is not responsible for any duties/taxes applied to your package upon delivery. You will be responsible for paying additional charges for customs clearance. Customs policies vary widely from country to country; please contact your local customs office for further information.

Payment

Customers may choose to pay by Direct Bank Transfer, Online Banking/ Credit Card/ Direct Debit, or other payment methods. LK Sport reserves the right to limit the method of payment chosen by the customer depending on order value, shipment destination, or other objective criteria.

If the customer selects a payment method or provides payment information that makes it impossible or impractical for LK Sport to receive payment (for example, the customer’s account lacks sufficient funds, or the customer provided incorrect payment information) through no fault of LK Sport own, the customer agrees that LK Sport may add an additional charge to the order to recoup costs associated with processing or attempting to process the impossible or impractical transaction.

LK Sport may sub-contract third parties to process payment.

If the customer fails to pay, LK Sport may assign its claims to a debt collection agency and transfer the personal data required for collecting payment to these third parties.

Returns & Refunds

For any reason you are not satisfied with your product, please contact us within 7 days from receipt of your order and explain to us what has gone wrong. Returns will not be accepted after 7 days or if they have been worn or washed incorrectly. Returns are not accepted on personalized T-shirts where personal artwork, images, or photos have been uploaded as we cannot guarantee the quality of artwork for unknown sources.

Items purchased online can be refunded in one of the following ways:
Items purchased online can be refunded once the customers do not received the item within 30days.
Item purchased online can be refunded once the item purchased was out of stock.
Any worn, soiled, altered, washed, or customer-damaged items cannot be returned and will be shipped back to you at your cost and no refund issued.

Disclaimers

You agree that LK Sport has no responsibility for any damages suffered by you in connection with the site and services, and that use of the site and services, including all content, data or software distributed by, downloaded, or accessed from or through the site and services, is at your sole risk. You understand and agree that you will be solely responsible for any damage to your business or your computer system or any loss of data that results from your actions and your use of the site and services. LK Sport does not control or endorse in any respect any information, products, or services offered by third parties through the site and services, and is not responsible for any possible representations and warranties these third parties may make.

Due to normal changes in our industry and in our technical production processes, LK Sport may reasonably deviate from the descriptions and information found in its catalogues, and other documents with respect to material, color, weight, measurements, design, or other features.
LK Sport may use subcontractors or third parties to provide certain elements of its site and services. You agree that LK Sport will not be liable to you in any way for your use of these services.

User Representations and Warranties; LK Sport Right to Refuse Performance

If you upload designs or make changes to products in any way (for example, adding custom text), you represent and warrant to LK Sport that you have all necessary rights (for example, in trademark, copyright, privacy rights, publicity rights, common law, etc.) to use the text or design without violating the rights of any third party. LK Sport may, in its sole discretion, refuse to print any designs or text that you submit. However, LK Sport is not obligated to review any of your submissions.

You agree to (a) indemnify and (b) release LK Sport from all liability (including costs and attorney’s fees) for claims relating to the alleged or actual infringement of any third-party rights and any law to the extent that such claims relate to your use of LK Sport site and service. If you are a shop owner with LK Sport, LK Sport may offset amounts in your shop owner account to satisfy the indemnification payments owed according to this paragraph.

Security

All information concerning your credit card is encrypted and secured. Most web browsers use symbols or the guide https:// to show that the page you are visiting is secured. LK Sport has to have your approval before handling your personal information. Receiving your personal information helps us to give you good customer service and updates. We will not leave or sell your personal information to any third-parties without your permission.

(a) Applicable law

These Terms and Conditions and all disputes arising in connection with these Terms and Conditions or with the use of the website or with any purchase on the website shall be governed by Swedish law. LK Sport may modify or amend these Terms and Conditions at any moment. You are therefore asked to accept only the Terms and Conditions applicable at the time of purchase with each of your orders.

(b) Ownership of right

All rights, including copyrights at lksport.com.my remain with LK Sport and its subsidiaries. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without our permission.

(c) Privacy Policy

The personal information you forward to LK Sport will only be used in order to fulfill the undertakings LK Sport have and to assure you the best service. LK Sport will not let a third party see or use your personal details without your prior consent. You have the right to see your personal details upon request. LK Sport assumes responsibility for all personal information that you make available to us and does not pass on any information to a third party under any circumstances. If the information is incomplete or incorrect, you have the right to have the information corrected or deleted.
